The Court of Appeal for Ontario allowed the conviction appeal in part, set aside the sexual exploitation-related convictions, ordered a new trial, and upheld the possession sentence.
Given the exploitive conduct toward two juvenile victims and the mandatory minimum for s.212(2), but noting the offences fell at the lower end of gravity among similar cases and the offender's mitigating factors and rehabilitation prospects, the appropriate global outcome is a sentence a notch above the mandatory minimum: 30 months' imprisonment for the prostitution-related offences (concurrent) and 3 months for the assault (concurrent); mandatory ancillary orders (SOIRA 20 years, forensic DNA order, weapons prohibition) were also imposed.
