Sabok Sir v. Canada
The Court found respondents did not establish proper service of the notice of appearance prior to filing but, applying the Rules to secure a just and expeditious resolution and exercising its discretion under Rule 145, ordered that respondents are to be served with any further documents because the appellant had received the notice of appearance thereafter and was aware respondents intended to participate; the Court also validated the service of the respondents' motion record under Rule 147 and dismissed the appellant's motion to remove that record, awarding costs of $750 for that motion.
