On rehearing, the court upheld the conviction for assault occasioning actual bodily harm and confirmed the 6-week sentence as not wrong in principle or excessive.
The court held the sentencing judge did not err: immediate detention was appropriate for assaults on custodial officers; 15 weeks per count was a lenient starting point compared with authorities; ordering 5 weeks of the second count to run consecutively (total 20 weeks) properly reflected distinct victims, injuries and culpability and was not manifestly excessive, so the appeal was dismissed.
The court accepted PW1's evidence as credible and corroborated by medical reports and photographs, found the appellant's account inconsistent and implausible, concluded self-defence was not established and that the appellant intentionally assaulted PW1 causing bodily harm; on that basis the conviction was safe beyond reasonable doubt and the seven‑day custodial sentence was not manifestly excessive.
The District Court assessed damages for a police constable injured in a 2019 assault, awarding HK$446,130 plus interest and costs after default liability judgment.
Court identified baseline sentences for each offence (triad membership 15 or 9 months depending on role; assault causing actual bodily harm 9 months; arson 36 months; failure to surrender 3 months), applied a one‑third reduction for timely guilty pleas, and then further adjusted sentences to reflect proven prosecutorial delay and individual mitigation. For less culpable participants and where delay and rehabilitation justified it, custodial terms were suspended; for serious arson the custodial element was maintained with partial concurrent execution and a compensation order imposed.
Conviction was upheld (appellant withdrew challenge). Appropriate starting point was 10 months after assessing seriousness and comparable cases; applying the one-fifth guilty plea discount reduced it to 8 months, and in fairness a further one-month discretionary reduction was made (consistent with the magistrate's earlier adjustment), resulting in a final sentence of 7 months' imprisonment.
After re‑examination of the evidence including the video, medical records and witness testimony, the appellate judge accepted the trial judge's credibility assessments and concluded the prosecution had proved beyond reasonable doubt that the appellant pushed PW1 causing injury; the conviction was therefore affirmed.
Although the offence was serious, the unique factual matrix — completed sexual service, post‑service argument, provocation, absence of permanent injury, early guilty plea, first offender status, substantial compensation and stable employment — made immediate imprisonment not inevitable. On re‑consideration of all evidence and a social service report, the court allowed the appeal and substituted a community service order of 160 hours for the 4‑month custodial sentence as the appropriate disposal in all the circumstances.
Assessment of damages arising from an assault by a taxi passenger. The court allowed late amendments, found the plaintiff exaggerated some complaints, and awarded HK$268,543 before interest.
