The Court found that special circumstances under s.73B(3)(b) existed because the Defendant conducted its defence oppressively and unreasonably (fighting every point, calling excessive witnesses and prolonging a trial that could have been shorter), thereby wasting Court and Plaintiff resources; accordingly the Defendant was ordered to pay 50% of the costs of the action to the Plaintiff, to be taxed if not agreed, with certificate for counsel.
