A former director does not retain an automatic common law right to inspect company books after removal; the court will only order inspection in the exercise of its discretion where appropriate and necessary and the applicant adduced insufficient evidence to justify such an order; article rights equivalent to s121(3) would have to be asserted in the applicant's capacity as a shareholder.
