On the prima facie analysis required by s20 AO, there is a clearly arguable case under Singapore law that Techteryx, pursuing derivative claims on behalf of Legacy Trust, is bound by the AIMM arbitration clause; there is no specific, direct attack on the arbitration clause itself that would render it null and void, and public policy/accessibility grounds were not established; therefore the appropriate course is to stay proceedings in favour of SIAC arbitration and to set aside the leave to serve out and the service effected.
