BAKER & MCKENZIE (A FIRM) v. THE GRANDE HOLDINGS LTD AND OTHERS

    Citation
BAKER & MCKENZIE (A FIRM) v. THE GRANDE HOLDINGS LTD AND OTHERS
    Court
    Court of Appeal
    Case number
    CACV102/2011

The Court held that s67(2) permits the court to impose terms, including interim payments, on taxation orders; the defendants' factual case that solicitors were negligent and entitled to set-off failed because contemporaneous instructions and public filings showed Mr Ho represented and exercised substantive control over GHL via the trust, so the deputy judge was entitled to award summary judgment and the ancillary orders; accordingly the appeals were dismissed with costs.
