The Registrar correctly applied s.20(1)(a) and there were reasonable grounds to conclude no likelihood of deception given the distinguishing features of the reserved names, absence of prior confusion complaints or successful passing-off against the defendant, and written submissions sufficed to satisfy natural justice; accordingly the judicial review application was dismissed and passing-off proceedings were the appropriate route for resolving competing goodwill claims.
