The court found that the 1st Defendant's case was not inherently incredible and that there were substantial disputed facts and unexplained commercial features on both sides that could not be resolved on affidavits; accordingly the Master's summary judgment was set aside and unconditional leave to defend granted, with permission to amend to plead illegality and to adduce the PRC lawyer's opinion.
