The Court refused to certify any of the four contested points under s32(2) because the alleged failure to give a Kevin Brown direction did not arise, the causation complaint was not reasonably arguable, the language complaint was neither advanced nor shown to render the trial unfair given translation and counsel representation, and the judge had expressly directed there was no evidence that the applicants knew of the thymus involution; accordingly no point merited certification.
