The court held that Mr Apostolis, employed by Sinclair Roche, did not act as a solicitor in breach of Legal Practitioners Ordinance s45 such that s50 rendered costs non-recoverable; Regulation 12 applied to collision matters involving international collision regulations and did not carry a non-recovery sanction, and therefore the Registrar's taxation allowing recovery for Apostolis' work at the assessed rate ($3,000/hour reduced from $3,500) was upheld.
