Application for leave to appeal out of time was refused because the application was unmeritorious, the applicant's assertions about judicial leave were unsupported, the applicant was responsible for delay which negated the mitigation, and the sentence was appropriate; however under s83W the court ordered that two months of custody pending the application be excluded from the sentence.
