SITA RAM (DEAD) THROUGH LRS. versus BHARAT SINGH (DEAD) THROUGH LRS & ORS.

Under the pre-amended scheme of the Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1950, the exchange deed executed without permission from the Assistant Collector was voidable and not automatically void. No suit was filed for ejectment within the prescribed period. The registered sale deed dated 24th January, 1973 was genuine and valid and unaffected by defects in the subsequent exchange transaction. Appellants have no locus standi to restore their rights based on defects in the exchange deed. The High Court's conclusions require no interference.

CHANDRAKANT BABAN MOTKARI & ORS. versus GOTIRAM LAXMAN MOTKARI (D) BY LRS. & ORS.

There is no uncertainty regarding tenancy status as certificate under Section 32M has been issued, is final and was unsuccessfully challenged; therefore, Civil Court need not stay proceedings or remit the issue to the Mamlatdar. The trial and appellate courts' concurrent findings are correct, and the suit is an impermissible attempt to reopen a settled issue.

  • Protected tenancy
  • Partition
  • Bar of civil court jurisdiction
  • Certificate under section 32m

BAYAJI SAMBHU MALI @ BORATE(D) THROUGH LRS. versus NAZIR MOHAMMED BALAL ZARI THROUGH GPA HOLDER & ORS.

When an application by the landlord under Section 29 is rejected (final order of rejection), the tenant acquires deemed purchaser status under the proviso to Section 32(1) and, having acquired that status, is not required to comply with the intimation requirement of Section 32F(1A); Sections 29/32 and Section 32F govern mutually exclusive situations.

Agricultural land law

GOHIL JESANGBHAI RAYSANGBHAI & ORS. versus STATE OF GUJARAT & ANR.

The restrictions imposed by Section 43 and the requirement of payment of premium at Government-determined Jantri rates as a precondition for conversion or transfer of tenanted land are valid and non-arbitrary; premium is not a tax or fee but a condition under agrarian reform; the rate applicable is as on the date of Collector's sanction; the applications for sanction should be decided within 90 days; reduction of levy from 80% to 40% renders the rate reasonable; there is no violation of Article 300A.

  • Restriction on transfer of agricultural land
  • Sanction by collector for land transfer
  • Levy of premium on land conversion

GOVINDA BALA PATIL (D) BY LRS. versus GANPATI RAMCHANDRA NAIKWADE (D) BY LRS.

The Tribunal was within its rights to set aside the finding of the Sub-Divisional Officer as the latter’s decision was perverse and failed to consider relevant evidence. Section 43A of the Act applies to leases granted to a single person as well, by virtue of Section 13 of the Bombay General Clauses Act, 1904.

NAGBHAI NAJBHAI KHACKAR versus STATE OF GUJARAT

'Bid lands' (whether cultivable or uncultivable) must be included for land ceiling computation under the Gujarat Agricultural Lands Ceiling Act, 1960, as amended by Act 2 of 1974, due to clear legislative intent expressed in the amendment and supporting Statement of Objects and Reasons, and given the amended definition of 'land' incorporates them without qualification. Sections 33-B and 88-C of the Bombay Tenancy and Agricultural Lands Act, 1948, operate in distinct fields, and bona fide requirement and personal cultivation are relevant only under Section 88-C. Mere application under Section 33-B does not sever landlord-tenant relationship until the Mamlatdar passes an order. Matter requires further clarification and is referred to a larger Bench.

N. SRINIVASA RAO versus SPL. COURT UNDER A.P. LAND GRABBING (PROHIBITION) ACT AND ORS.

The action of the legal heirs of the protected tenant does not constitute land grabbing since actual dispossession did not occur. Transfer of agricultural land by a protected tenant to a non-agriculturist is void under the Tenancy Act; transferees therefore cannot claim title. The Special Court under the Land Grabbing Act does not have jurisdiction to decide title by adverse possession, and the provisions of the Transfer of Property Act are not applicable as the initial transfer is void.

  • Land grabbing
  • Void transfers
  • Adverse possession
  • Jurisdiction of special courts
