The appellant cannot be declared sole heir as Basotho law and custom require sharing of inheritance among brothers and family arbitration before court intervention. The concept of 'sole heir' as claimed by the appellant is unknown in Lesotho law. Additionally, the appellant's British citizenship may disqualify him from inheriting land in Lesotho, a matter for the Minister to decide.
