Ratio Decidendi

Negligence was established against the first Defendant, and the second Defendant is vicariously liable. The third Defendant, as insurer, is liable to compensate the Plaintiff because it failed to produce the actual policy document proving an exclusion clause. Even if such a clause existed, it would not exclude liability to the Plaintiff under the facts. The Plaintiff is entitled to damages for his injuries, loss of amenities, and loss of earning capacity.
