Ratio Decidendi

Compensation for unfair dismissal is to be calculated primarily on the duration of service, with enhancements above the statutory minimum justified by long service and lack of contribution to dismissal. Mitigation of loss is not a relevant factor under the Employment Act. Severance pay is based on basic salary and car allowance only. Due to significant currency devaluation, a 50% boost to the total compensation is justified to retain the value of the awards.
