  1. 1 Whether the Ombudsman had jurisdiction to determine complaints of unfair dismissal, unfair labour practices, unfair redundancy, and misallocation of gratuity funds
  2. 2 Whether the Ombudsman breached rules of natural justice in the conduct of the inquiry

Ratio Decidendi

The Ombudsman lacked jurisdiction to determine complaints of unfair dismissal, unfair redundancy, and unfair labour practices as these fall within the exclusive jurisdiction of the Industrial Relations Court. The Ombudsman also failed to adhere to rules of natural justice by not affording the affected parties an opportunity to challenge evidence. However, the Ombudsman had jurisdiction over complaints of abuse of power and misallocation of funds. Directions relating to systemic reforms and further investigations stand, while employment-related remedies are quashed.
