Applicant's claim for costs was declined because New Zealand law follows an established rule that litigants in person are not entitled to costs except in exceptional cases, the present case was not exceptional, the applicant did not provide expert assistance comparable to Lincoln v Police, and Judge Down's error was not perverse or in bad faith; however certain modest disbursements meeting r14.12 were recoverable and the second respondent was ordered to pay $28.00.
