MIHAKA v HOUSING NZ CORP [2018] NZHC 539
- Citation
- [2018] NZHC 539
- Court
- High Court
The HRRT was entitled to dismiss the discrimination claim for want of prosecution because the appellant repeatedly failed to comply with timetable directions, failed to attend scheduled hearings without adequate and particularised medical evidence, pursued collateral matters beyond the Tribunal's jurisdiction, and caused real prejudice to the respondent and to scarce Tribunal resources; the dismissal was proportionate given the absence of an arguable discrimination case and the lack of ongoing prejudice to the appellant.
