The Court found the appellant remained actively engaged with ACC during the three month period, there was no evidence the appellant left all responsibility to the advocate nor that the advocate unreasonably failed to lodge the review within the statutory period, and therefore no extenuating circumstances under s135(3)(b) were established; the respondent's decision and the Reviewer’s confirmation were correct.
