The Court refused defendants' application to inspect plaintiffs' solicitors' and accountants' binders and declined to order individual listing of privileged documents generally or in respect of the settlor; it held joint interest privilege applied to communications with the settlor and that broad categorical claims of privilege were proportionate; however the plaintiffs were ordered to comply with discovery rules to disclose whether relevant documents are no longer in their control, when possession was lost and who now has control (r 8.19).
