Causation between physical and psychiatric injury
  • 19 Dec 2017

Smith v Accident Compensation Corporation (Cover for Mental Injury)

    Citation
    [2017] NZACC 150
    Court
    District Court

Although the May 2013 diagnosis of major depression was accepted, the evidence did not establish that the depression was caused by the 2007 covered wrist injury after the earlier October 2012 assessment; there is insufficient basis to find the required causal link and therefore cover for a mental injury is not established; appeal dismissed.
