The Tribunal erred as a matter of law in concluding it lacked authority to appoint and fund counsel assisting to conduct cross-examination; the Ministry of Justice appropriation under the Public Finance Act authorises funding for services supporting specialist tribunals and, together with the Evidence Act and Real Estate Agents Act procedural powers, permits the Tribunal to appoint and meet costs of counsel assisting under s95(5)(b); the Tribunal's decision is set aside and the matter remitted for rehearing.
