The Court granted leave to appeal and formally approved the single question whether the applicants have an interest in the Oyang 75 for the purposes of s 256 of the Fisheries Act 1996; the Court directed that counsel address whether the vessel is forfeit property, whether the applicants are "any fishing crew", whether they hold unpaid wages claims that constituted in rem rights prior to forfeiture, and whether those rights are encompassed by the statutory phrase.
