Grandparental leave to apply

    JK v KL [2022] NZHC 2503

    Citation
    [2022] NZHC 2503
    Court
    High Court

Leave to apply for grandparental contact was properly granted because the applicants demonstrated an arguable and sustainable interest, but a parenting order for contact was denied because imposing contact would, given NO's expressed views, age, maturity and the real risk of psychological abuse, diminish his welfare and best interests; the Family Court's approach of prioritising 'upskilling' over protection was erroneous.
