THE DISTRICT COURT AT CHRISTCHURCH v MCDONALD [2021] NZCA 353

    Citation
    [2021] 3 NZLR 585
    Court
    Court of Appeal

The Court of Appeal held the District Court judges lawfully exercised inherent supervisory and allocative powers to direct that family-violence-related bail applications (and in Christchurch bail-variation applications) be dealt with by judges rather than registrars; those inherent powers are not clearly ousted by the statutory conferral of limited bail powers on registrars, and the High Court erred in setting the directions aside.
