New evidence and unsafe conviction

    BLAND v R [2013] NZSC 93

    Citation
    [2013] NZSC 93
    Court
    Supreme Court

Leave to appeal was refused because the matter, while of general importance, was unsuitable in the present case: the applicant did not raise assistance before the Court of Appeal, his assistance was belated and apparently self-serving, it was not essential to prosecutions so any discount would be modest, and there was no appearance of a substantial miscarriage of justice warranting Supreme Court intervention.

    • Sentence discount for assistance to authorities
    • Recall of appellate judgment
    • New evidence and unsafe conviction
    • Procedural bars to raising new grounds
