Leave to amend the leave application is granted but leave to appeal is dismissed because the Court of Appeal conducted a thorough fact specific review of the judge's interventions, the interventions were not shown to be improper under s 85 nor to have caused an unfair trial or substantial miscarriage of justice, and the age of the complainant was not placed in dispute at trial.
