    CURRIE v DOE [2023] NZHC 1508

    Citation
    [2023] NZHC 1508
    Court
    High Court

The Court was satisfied on affidavit evidence that the five online publications were published in New Zealand and were defamatory in their natural and ordinary meaning (except specific subparagraphs B6–B8), no viable defence was pleaded, prior limitation arguments had been rejected, and consequently a declaration under s24 Defamation Act 1992 was an appropriate remedy against the anonymous defendants named as John Doe and Jane Doe.

    • Declaration under s24 defamation act 1992
    • Publication jurisdiction for online material
    • Anonymous defendants (john/jane doe)
    • Limitation defence under s11 limitation act 2010
    • Strike out and removal of parties
