Procedural Posture

Administrative Appeal / Supreme Court Judgment

  1. 1 Whether the appeal against the public auction was admissible or barred as an enforcement dispute
  2. 2 Whether the public auction was conducted in accordance with legal procedures
  3. 3 Whether the sale to Yansoneye Consolée was valid after attachment

Ratio Decidendi

The Supreme Court held that Mukamusoni's claim was not a dispute arising from enforcement of judgment but a challenge to the legality of the auction, making the appeal admissible. The Court found no procedural irregularities in the auction process, as Mukamusoni failed to specify which documents were not served and the auction price was not proven to be unfair. The sale to Yansoneye was void as it occurred after attachment. Mukamusoni was entitled to reimbursement of the prorated fee paid twice and the auction balance. Kamali was entitled to damages, but only partially as claimed.

Court Disposition

Appeal allowed in part; cross-appeals of Yansoneye dismissed; Kamali's cross-appeal allowed in part; auction upheld.
