Ontario Court of Appeal upheld convictions for sexual offences and dismissed most sentence concerns, reducing the global sentence by four months on two counts.
Bail review affirming detention of Richard Gordon Titchener after serious sexual-assault allegations and later threats, forgery, and obstruction allegations supported continued detention.
The appeal was dismissed because the trial judge's detailed credibility findings were entitled to deference and the single material error (incorrect reference to a preliminary inquiry) was harmless; even if the nurse practitioner's evidence on chlamydia causation were discounted, other evidence and commonsense supported a single continuing infection and the conclusion that the appellant committed the assaults.
The Court held there was no reversible error: the trial judge was not obliged to single out collusion and relate it to credibility absent a specific request, his handling of counsel's speculative remarks about medical examinations was adequate, and the total 8‑year sentence was not clearly excessive given the gravity of the offences, the appellant's position of trust and his prior conviction.
