The Court refused to treat the Notice of Abandonment as a nullity because the applicant failed to adduce credible evidence that his abandonment was not deliberate and informed; he knew the nature and effect of the document, and the judge correctly exercised discretion to reduce (to 25%) the guilty plea discount after a properly conducted Newton hearing which found the applicant had lied to obtain mitigation.
