The Court held that leave to treat the earlier abandonment as a nullity was properly granted because there was an arguable point of wrong advice; however trial counsel's tactical decision not to pursue a voir dire or formal ruling on voluntariness did not amount to flagrant incompetence and the trial judge would in any event have excluded the statement of his own motion if he had been satisfied it was involuntary; accordingly the grounds of appeal failed and the application was dismissed, upholding the conviction and sentence.
