The court held the magistrate had adequately evaluated credibility and discrepancies and that omissions in oral descriptions of demonstrations did not constitute material irregularities given the context and the evidence as a whole; accordingly the conviction appeal was dismissed. However the original two‑month custodial sentence was disproportionate for a conviction of common assault given the appellant's previous good character and the nature of the offence, so the sentence was quashed and substituted with 14 days' imprisonment.
