The Court of Appeal refused to interfere: the trial judge correctly applied the paramountcy principle and, having assessed parental capacities and future prospects, legitimately concluded it was in the child's best interests for weekday residence and primary term‑time care to be with the mother (who offers flexible hours and educational stimulation) while retaining legal custody with the father to preserve family links; accordingly the detailed shared care schedule was appropriate and the appeal was dismissed with no order as to costs.
