The Court concluded the trial judge erred in assessing key evidence (notably the mother's post‑July 2009 reduction in alcohol consumption, unreliability of certain witnesses, and the significance of the maternal role and child’s attachment), and that the balance of the children’s welfare favoured joint custody with care and control to the mother; accordingly the June 2010 order granting sole custody to the father was set aside and prior arrangements reinstated with modifications.
