The court refused to appoint an administrator pendente lite because, although the 1st defendant failed to give a good explanation for delay in enforcing the Consent Judgment, there was no evidence that the Estate suffered loss or that assets were at risk of dissipation and the Estate's assets (including an offer for the Property) were sufficient to cover potential loss; instead the court ordered the 1st defendant to use his best endeavours immediately to require APHL to give the account under the Consent Judgment and warned that failure may lead to his removal and adverse costs orders.
