Section 18A is an administrative restriction on ICAC's investigatory duties and does not confer a private right of immunity; moreover a s10 offence is not necessarily committed until the accused fails to explain at trial, so s18A's cut-off date does not bar prosecution; in any event ICAC had investigated before the amendment, therefore the defendant is not entitled to acquittal.
