The court found that joint legal ownership of the FMH, carparks and DBS joint accounts carried joint beneficial ownership; transfers by petitioner into husband’s sole account were consistent with a shared arrangement and the DBS accounts were mixed joint savings. Husband unilaterally withdrew c.HK$1.10m; after scrutinising expenditures the court identified reckless/unjustified payments (GBP20,000 to father and GBP10,000 of a GBP15,000 sister gift) and, after calculating husband’s legitimate needs, found an unexplained shortfall of HK$488,600 which must be added back to the matrimonial pot.
