The pleaded claims for the outstanding purchase price and related losses (paragraphs 44, 46 and 47) were struck out because the loss asserted is one which can be made good by the company (China Dragon) enforcing its rights against the 2nd defendant and therefore is merely reflective of the company's loss; accordingly the no reflective loss principle bars the plaintiff's personal recovery; the plaintiff's application to adduce evidence out of time was refused for failure to show exceptional circumstances under Order 32 r11A(4) RHC.
