The Court upheld the convictions because no material trial irregularity or nondisclosure that could have affected the verdict was shown, the trial judge properly evaluated credibility and applied the Ghosh test including its subjective limb, and adverse inferences were justifiable; however, on review the Court found the original sentence manifestly inadequate for the serious breach of trust involving client funds and absence of cooperation or restitution and substituted a longer custodial term (count 1 increased to five years, count 2 left concurrent and undisturbed).
