Given the solicitors' unambiguous letters that they could not obtain instructions and their notification of the Official Solicitor, there was sufficient concern about the defendant's mental capacity on the trial date to warrant examination before proceeding; continuing without such inquiry risked irregularity and denial of natural justice, therefore the matter must be re-listed for inquiry and a trial de novo ordered.
