Bail was refused because the applicant's new grounds attacked only factual findings of the trial judge, whose finding of intent to extort was reasonable; the applicant failed to show arguable grounds or exceptional circumstances and public interest and court scheduling justified refusal of bail and refusal to adjourn the appeal.

The application for judicial review was academic because events after the Tribunal's refusal produced the identical practical outcome sought by the Applicant; accordingly no relief is granted and the court makes no order on the application.

The court held that, although it had jurisdiction to hear the appeal in the appellant's absence, it was proper to adjourn the appeal and to exercise powers under sections 18A and 119(1)(d) of the Magistrates Ordinance to issue a warrant for the appellant's arrest for breach of recognizance.
