The appeal was allowed because, after the section 121 affidavit was excluded for non‑compliance with section 121(10), the oral evidence adduced (PW5 and PW9) lacked the specific particulars required by section 121(1)(a)-(e) and therefore no reasonable tribunal could have been satisfied that the prosecution proved ownership and subsistence of copyright in the five discs; the convictions were unsafe.
