The magistrate correctly admitted and relied on the affirmation and witness evidence despite non‑compliance with s.121(10) because no prejudice was shown; Mr Ting/Li's firsthand knowledge and documentary indicators were sufficient to find the DVDs were unauthorised infringing copies rather than parallel imports; and possession by the appellants was proven by direct observation, custody indicators (keys, tenancy, bills, identity documents) and the presence of the discs, so the appeals were dismissed.
