The magistrate erred by excluding WhatsApp records under the hearsay rule and s22A because the appellant tendered them to prove the statements were made (relevant to his state of mind) not to prove the truth of their content; that exclusion, together with failure to recognise supporting indicia for the appellant's account, rendered the conviction unsafe and warranted quashing.
