The conviction for possession for the purpose of trafficking was unsafe because the magistrate failed to give adequate reasons to reject the appellant's sworn defence and to explain why the statutory presumption under section 46 was not rebutted; on that basis the Court allowed the appeal and substituted a conviction for simple possession of dangerous drugs.
