Even if the Applicant did not personally strike the victim, the uncontroverted evidence that both men entered, went to the victim's table, an assault occurred and both fled established participation in a joint enterprise; no reasonable alternative inference was available, so the conviction was upheld.

The Court refused leave to appeal against conviction because the jury were properly directed and there was no realistic evidential basis for an alternative simple possession verdict; the Court allowed the sentence appeal, holding the consecutive seven month term on the third count was manifestly excessive and should run concurrently with the six year sentence, reducing total detention to six years.

The Court held that the Magistrate properly considered the evidence, was entitled to conclude that the appellant committed the indecent assault as described, did not improperly rely on demeanour, and did not rely on any alleged admission to PW2; accordingly there was no miscarriage of justice and the appeal was dismissed.
