Although the defendant was acquitted, the court found on the whole of the evidence that the defendant's conduct gave rise to real suspicion (online relationship with a 13‑year‑old, knowledge or belief of her age, sexually explicit online behaviour, bringing the girl to his home and periods of isolation over six months), and therefore exercised its discretion to refuse the usual award of costs to the acquitted defendant.
