The trial evidence proved the appellants, as owners, failed without reasonable excuse to comply with a valid Buildings Department demolition/remedial order issued 21 September 2012; their asserted safety motive and prior administrative tolerance did not constitute an objectively reasonable excuse; the application to admit new evidence failed the statutory tests and the convictions are therefore safe and must be upheld.
